The United States government defines obscenity as “The character or quality of being obscene; an act, utterance, or item tending to corrupt the public morals by its indecency or lewdness.” If you don’t follow what is going on in the world of adult entertainment you may not have heard about the recent obscenity trial of adult pioneer John Stagliano. The case ended up being thrown out because the prosecution inability to prove there case. This is a victory for the adult industry and more importantly to first amendment rights.
The key thing about the case was what is obscene. The truth is the government can’t define what it is. Their only definition is that obscenity is any act that goes against a community’s moral values. Here’s the problem though, how can the government or the prosecution actually determine what the community standards are without asking every single person if they find this specific item obscene? The truth is they determine what is obscene cased on their own morals.
One thing that I do think would be fair would be for the government to pay John’s legal bills. I know that won’t happen but considering how they should have never come after him in the first; it does seem like the right thing. Anyway I just wanted to tell you all about my thoughts on this. I hope to get more regular stuff up like this in the future. Things have been crazy around here though.
